1. Introduction
Welcome to Mobiai ("we," "us," "our"). These Terms of Service ("Terms") govern your access to and use of the Mobiai mobile application ("App"). By downloading, installing, or using Mobiai, you agree to these Terms. If you do not agree, please do not use the App.
Important Notice: Mobiai provides cosmetic, educational, and entertainment insights only. It is not a medical tool, and it does not provide medical advice, diagnosis, or treatment.
2. Eligibility
You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use Mobiai. If you are under that age, you may only use the App under parental supervision and consent. By using Mobiai, you confirm you have legal capacity to accept these terms and will comply with all laws and regulations.
3. Services & Access
Mobiai offers face analysis and visual recommendations as a lifestyle tool. Key features include:
• Photo-Based Analysis: Upload or capture a photo to receive a cosmetic score (1–10) and a short recommendation (up to 20 words).
• AI Skincare Routine: Receive personalized skincare routines and product recommendations based on your facial analysis.
• AI Skincare Assistant: Interactive chat feature for personalized beauty advice, skincare questions, and cosmetic guidance (requires subscription or 3-day free trial).
• Progress Tracking: Graphs, streaks, and visual history to monitor changes over time.
• Shareable Content: Optional images combining your photo, score, and Mobiai branding for personal use or sharing.
• Access Control: Access to core functions is gated by subscription. Free users see subscription prompts before using Gallery or Camera features.
All outputs are intended for cosmetic, educational, or stylistic use only.
3.1 AI Skincare Assistant - Terms of Use
The AI Skincare Assistant is an interactive chat feature that provides personalized cosmetic and beauty advice. By using this feature, you agree to the following terms:
3.1.1 Feature Description
The AI Skincare Assistant allows you to:
• Ask questions about skincare routines, products, and cosmetic concerns
• Receive personalized beauty recommendations through conversational chat
• Analyze images of your skin within the chat for targeted advice (requires active subscription or 3-day free trial)
• Get educational information about skincare ingredients and regimens
• Explore cosmetic topics in a conversational format
3.1.2 Subscription Requirement
• The AI Skincare Assistant requires an active paid subscription or 3-day free trial to access all features
• Image analysis within the chat is available only with an active subscription or during the free trial period
• Text-based chat may have limited availability without a subscription
• Subscription terms are governed by Section 7 of these Terms of Service
3.1.3 Medical Disclaimer - Not for Medical Use
CRITICAL NOTICE: The AI Skincare Assistant is NOT designed for medical purposes and does NOT provide medical advice, diagnosis, or treatment.
You acknowledge and agree that:
• The AI Assistant provides cosmetic and beauty insights ONLY
• All recommendations are for educational and entertainment purposes
• The AI Assistant does NOT replace professional medical consultation
• You will NOT use the AI Assistant for diagnosing skin diseases, conditions, or medical issues
• You will consult a licensed dermatologist or healthcare professional for any medical concerns
• Mobiai is not liable for any medical issues arising from reliance on AI Assistant recommendations
By using the AI Skincare Assistant, you confirm that you understand it is a cosmetic tool only and not a medical service.
3.1.4 Data Protection and Privacy
Your privacy in the AI Skincare Assistant is protected as follows:
• Local Storage: All chat conversations are stored LOCALLY on your device only
• Zero Server Storage: MobiAi servers do NOT store, retain, or keep ANY copies of your chat messages or history
• ChatGPT API Processing: Your messages are processed using OpenAI's ChatGPT API to generate responses. Messages are sent directly from your device to OpenAI's servers and responses are returned to your device. MobiAi acts as a secure bridge but NEVER stores the chat content
• Encrypted Transmission: All communication uses secure HTTPS encryption
• No Data Selling: Your chat data is NEVER sold, shared with advertisers, or used for marketing
• OpenAI Processing: According to OpenAI's policies, API data is NOT used to train their models and is automatically deleted (typically within 30 days maximum)
3.1.5 Image Analysis in Chat
If you choose to share images within the AI Skincare Assistant (requires subscription or free trial):
• Images are sent directly to OpenAI's ChatGPT API for cosmetic analysis
• Images are processed temporarily and automatically deleted after analysis
• Images are NOT stored on MobiAi servers
• Local copies of images shared in chat remain on your device only if you choose to save the conversation
• You retain ownership of all images you share
• You grant MobiAi and OpenAI a limited, temporary license to process images solely for generating cosmetic analysis and recommendations
3.1.6 User Control and Data Deletion
You have complete control over your AI Skincare Assistant data:
• Chat Settings: You can access Chat Settings within the app to manage your chat data
• Erase Conversations: You can delete individual messages, conversations, or all chat history instantly from Chat Settings
• No Server Copies: Deleting chat data from your device permanently removes it (MobiAi has no server copies to delete)
• App Uninstall: Uninstalling the app will permanently delete all local chat data
• No Recovery: Once deleted from your device, chat data cannot be recovered by MobiAi
3.1.7 User Responsibilities for AI Assistant
When using the AI Skincare Assistant, you agree to:
• Use it for personal, non-commercial cosmetic advice only
• Not rely on it for medical diagnosis or treatment
• Provide only images you own or have permission to share
• Not share offensive, illegal, or inappropriate content
• Understand that AI-generated advice may not be perfect or suitable for your specific situation
• Take personal responsibility for any skincare decisions you make based on AI recommendations
• Regularly delete chat history if you have privacy concerns
3.1.8 Limitations and Disclaimers
The AI Skincare Assistant is provided "as is" with no guarantees:
• We do not guarantee the accuracy, completeness, or suitability of AI-generated recommendations
• AI advice is generated by OpenAI's ChatGPT and may contain errors or outdated information
• Recommendations are general in nature and may not be appropriate for your specific skin type or conditions
• We are not responsible for adverse reactions, allergies, or skin issues arising from following AI recommendations
• OpenAI controls the AI processing; we are not responsible for their data handling (governed by their policies)
• The AI Assistant may be temporarily unavailable due to technical issues or maintenance
4. User Responsibilities
By using Mobiai, you agree to:
• Use it for personal, non-commercial purposes only.
• Provide truthful info in onboarding and usage.
• Ensure any photos used are yours or you have permission to use them.
• Maintain device security and manage local data.
• Respect trademarks, copyrights, and all intellectual property.
• When using AI Skincare Assistant, understand it's for cosmetic advice only (not medical purposes).
• Manage your chat history and delete conversations as needed from Chat Settings.
5. User Content & Data Handling
"User Content" refers to photos you provide, onboarding inputs, images generated for sharing, and AI Skincare Assistant chat messages and images.
• Ownership: You retain ownership of your photos, chat messages, and inputs.
• License to Mobiai: You grant Mobiai a limited, temporary, non-exclusive license to process these photos and chat messages solely for the purpose of analysis and generating outputs.
• Third-Party Processing: Photos and chat messages are sent to OpenAI (ChatGPT API) for analysis and conversation. OpenAI processes data according to their own privacy policies and data retention standards.
• Storage & Deletion:
- Photos are deleted from your device immediately after being sent to OpenAI
- Chat messages are stored locally on your device only - MobiAi does NOT store chat history on servers
- You can delete chat messages anytime from Chat Settings
- OpenAI deletes data according to their policies (typically within 30 days)
- Generated scores, graphs, skincare routines, or shareable content may persist locally on your device
• Branding: Generated shareable images may include Mobiai's logo and branding, which remains our property.
6. Face Data Usage Terms
By using Mobiai's face analysis features, you acknowledge and agree to the following:
6.1 Consent to Face Data Processing
You voluntarily provide facial photographs for cosmetic analysis purposes only. You understand that:
• Face data is sent to OpenAI (ChatGPT API) for analysis
• Photos are transmitted via secure encrypted connections
• Face data is NOT used for biometric identification, authentication, or facial recognition
• Analysis is purely for cosmetic assessment and educational feedback
6.2 Permitted Uses of Face Data
You agree that Mobiai and OpenAI may use your facial photographs exclusively for:
• Generating cosmetic scores (1-10 scale)
• Providing personalized cosmetic recommendations
• Creating personalized AI skincare routines and product recommendations
• Creating progress tracking graphs and visual trends
• Generating shareable images (if you choose to create them)
6.3 Prohibited Uses
Mobiai and OpenAI will NOT use your face data for:
• Medical diagnosis, treatment, or clinical purposes
• Biometric authentication or identification
• Selling or trading to third parties for profit
• Advertising or marketing purposes
• Facial recognition or tracking individuals
• Training AI models (per OpenAI policies)
6.4 Data Retention and Deletion
You acknowledge that:
• Original facial photos are automatically deleted from your device immediately after being sent to OpenAI (within seconds)
• OpenAI retains images temporarily for processing and deletes them according to their policies (typically within 30 days maximum)
• Analysis results (scores, graphs, skincare routines) may be retained locally on your device for progress tracking
• You can delete all local data by uninstalling the app
• Shared images are saved to your device's photo library under your control
6.5 Third-Party Sharing
You understand and agree that:
• Your face data IS shared with OpenAI for AI analysis purposes only
• OpenAI processes images according to their own privacy policies
• OpenAI does not use API images to train their models
• Mobiai does NOT share your face data with advertisers, marketing companies, or data brokers
• Apple App Store / Google Play Store handle billing only and do NOT receive face data
6.6 User Rights
You have the right to:
• Stop using face analysis features at any time
• Delete all local data by uninstalling the app

• Review OpenAI's privacy policies for information about their data handling practices
7. Subscriptions & Billing
• Subscription Required: Pro features (including AI Skincare Assistant with image analysis) require an active subscription.
• Free Trial: The yearly plan includes a 3-day free trial. The monthly plan does not include a free trial.
• Auto-Renewal & Notifications: Subscriptions auto-renew unless canceled via your device settings. We will notify you at least 24 hours before the trial period ends or subscription renews.
• Payment Processing: All payments are handled securely by Apple App Store and Google Play. Mobiai does not collect or store your payment credentials.
• Cancellations & Refunds: You can cancel anytime in your device's subscription settings. Cancelling before the end of the trial means you will not be charged. Refunds, if any, are handled via the App Store/Play Store policies.
8. Restrictions
You agree not to:
• Use Mobiai for medical diagnosis, treatment, or advice.
• Use the AI Skincare Assistant for medical purposes or rely on it for health decisions.
• Reverse-engineer, decompile, or modify the App.
• Use the App to generate or share illegal, harmful, or offensive content.
• Share inappropriate, offensive, or harmful content in AI Skincare Assistant chat.
• Violate laws or misrepresent the outputs as professional or medical advice.
• Use face data or chat data for any purpose other than personal cosmetic analysis.
• Attempt to bypass subscription requirements or share subscription access.
9. Intellectual Property
All rights, titles, and interest in the App, its design, interface, software, branding, and generated content (excluding your photos) are owned by Mobiai Team. You receive a limited, non-exclusive, non-transferable license to use the App for personal purposes.
10. Disclaimers
Mobiai is provided "as is" with no warranties. We cannot guarantee uninterrupted service, error-free performance, or 100% accurate results. All outputs are cosmetic and educational. This app does not replace professional medical advice.
Skincare routines and product recommendations are generated by AI for educational and cosmetic purposes only. They are not medical prescriptions or professional dermatological advice. Always consult a licensed healthcare professional before starting any new skincare regimen.
We are not responsible for how OpenAI handles your data. Their processing is governed by their own privacy policies and terms of service.
11. Limitation of Liability
To the fullest extent allowed by law, Mobiai is not liable for any damages—direct, indirect, incidental, or consequential—arising from your use of the App. Use is at your own risk. This includes device malfunction, data loss, misuse of results, unauthorized sharing, or third-party data handling.
12. Children & Minors
Mobiai is not directed to children under 13. We do not knowingly collect information from children without parental consent. If we discover a minor is using the App without permission, we will remove their data promptly.
13. Termination
You can stop using the App anytime (e.g. by uninstalling). We may suspend or terminate access if Terms are violated. Termination does not affect rights or obligations accrued earlier.
14. Updates & Changes
We may update these Terms to reflect changes in the App, law, or business. Updated Terms will be published in the App (and/or website). Continued use post-update means acceptance.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of Sri Lanka. Any disputes will be resolved in the courts of Sri Lanka.
